Can an estate be partitioned without a lawsuit?
If all the heirs agree, they may partition the estate by mutual agreement and document it; if they disagree, or a minor is among them, the partition requires the court.
Can an heir be forced to remain in co-ownership?
No co-owner can be compelled to remain in co-ownership. Every heir may request the partition of jointly owned property, and if it cannot be divided in kind, it may be sold and the proceeds divided.
Who manages the estate’s real estate before partition?
The heirs manage it by agreement or through an agent they appoint. In the event of disagreement, the appointment of a manager may be requested, and the income is preserved for all the heirs according to their shares.
