Frequently Asked Questions

Which cases fall within the jurisdiction of the Commercial Court?

The Commercial Court hears disputes between merchants arising from their commercial activities, disputes between partners in companies, and cases concerning the companies, bankruptcy and intellectual property laws, among other matters set out in the Commercial Courts Law.

Can a cheque be enforced directly without a lawsuit?

Cheques, promissory notes and bills of exchange are enforceable instruments, so the holder may apply directly to the Enforcement Court for their enforcement provided they meet the statutory requirements.

What is the difference between a commercial claim and an ordinary financial claim?

A commercial claim arises from a commercial act and is heard by the Commercial Court, while financial claims between individuals outside commercial activity are heard by the General Courts. Identifying the competent court shapes the course of the case from the outset.
